5. Denuncia de actividad ilícita, notificaciones y jurisdicción

This Legal Notice is governed by the laws of the Argentine Republic. Both Bodega Maria Luisa S.A.S. and the User submit exclusively to the jurisdiction of the courts of Mendoza, Argentina, 1ª Circunscripción.

Los pedidos realizados en la UE son gestionados por esa empresa según sus propias condiciones.
Solo tratamos los datos personales que usted mismo nos facilita, con los siguientes fines y bases jurídicas:
- Responder consultas y organizar visitas, degustaciones, cenas y estadías: ejecución de un contrato o actuaciones previas, art. 6.1.b del RGPD.
- Consultas comerciales y de prensa: ejecución de un contrato y nuestro interés legítimo en responder a un contacto comercial, art. 6.1.b y f del RGPD.
- Envío de nuestro newsletter: su consentimiento, art. 6.1.a del RGPD, que puede retirar en cualquier momento sin afectar el tratamiento ya realizado.
- Confirmar que tiene la edad legal para consumir alcohol: obligación legal e interés legítimo, art. 6.1.c y f del RGPD. Esa confirmación se guarda únicamente en su navegador y no se nos transmite.

Plazos de conservación
La correspondencia de consultas y reservas se conserva el tiempo necesario para atender su solicitud y, más allá de eso, solo cuando la legislación comercial y fiscal argentina lo exige. Las direcciones del newsletter se conservan hasta que usted se dé de baja. Los registros del servidor son eliminados o anonimizados por nuestro proveedor de alojamiento al poco tiempo. Cuando los datos ya no son necesarios para ninguno de estos fines, los eliminamos.
Quién recibe sus datos
No vendemos datos personales ni los usamos para perfiles publicitarios. Además de nosotros, pueden tratar sus datos: nuestro proveedor de alojamiento y correo; el motor de reservas hotelpms.io, cuando usted reserva una habitación; Google Workspace, donde se reciben y guardan las consultas y las suscripciones al newsletter; Perdriel Wine Import GmbH para pedidos y consultas comerciales en la UE; y, cuando la ley lo exige, autoridades públicas. Cada encargado actúa según nuestras instrucciones y con un contrato de tratamiento de datos.
El sitio carga sus tipografías desde Google Fonts, de modo que su dirección IP se transmite a Google al abrir una página. Este sitio no instala cookies de análisis, seguimiento ni publicidad; el único valor guardado en su dispositivo es la confirmación de edad, que permanece en su navegador.
Transferencias a Argentina
Como estamos radicados en Argentina, los datos que nos envía se tratan allí. La Comisión Europea reconoció que Argentina ofrece un nivel adecuado de protección de datos mediante la Decisión 2003/490/CE del 30 de junio de 2003, por lo que dicha transferencia no requiere garantías adicionales. Cualquier transferencia a un país sin decisión de adecuación se realiza sobre la base de las cláusulas contractuales tipo de la Comisión Europea.

- Retirada del consentimiento en cualquier momento, art. 7.3 del RGPD, por ejemplo mediante el enlace de baja de cualquier newsletter;
