Privacy Policy
This website is managed by Bodega Maria Luisa S.A.S., Espejo 65, 1° Piso Dpto. F, (5500) Mendoza Ciudad. By submitting your personal details you accept this Privacy Statement and consent to our use of your information as set out here. It forms part of the Terms and Conditions for using this site.
Do not provide personal information if you are not of legal age to purchase alcohol where you live or where you access the site. We do not collect information from, or market to, those under the legal purchase age; where such information is inadvertently collected we remove it as far as the law allows.
Providing personal information is voluntary and it is only collected when you choose to give it: through registrations, enquiries, surveys or promotions. You control its use, particularly in opting in or out of marketing communications.
Cookies and how we use your information
This website uses no analytics, tracking or advertising cookies, so no cookie consent is required. The only value stored on your device is the confirmation that you are of legal drinking age, kept in your browser so that you are not asked again; you can clear it through your browser settings. Should we ever add analytics or marketing cookies, we will ask for your consent beforehand and you will be able to refuse just as easily as accept.
We may use your personal information to communicate with you about our products and services (you can opt out at any time), to assess trends and traffic, to process transactions, in connection with a sale, merger or similar event, and to comply with the law, protect against fraud or ensure security.
We may disclose personal information to service providers performing operational functions such as warehousing, marketing and IT, under strict confidentiality terms; where necessary to fulfil a transaction or as legally required; and to third parties with your consent or to your legal representatives.
Security, access and external sites
We use physical, electronic and managerial safeguards to protect your information, though no security system is infallible, and we are not responsible for the privacy of communications sent by email. We will notify you promptly if we believe your personal information has been compromised.
On request we will give you access to your personal information, correct it, or delete it as required by law. You may receive communications about Bodega Maria Luisa S.A.S. brands or related brands you have not specifically opted into; each will include an option to unsubscribe.
Our site may link to external sites we do not control, and this policy does not apply to them. We operate under the legal requirements of the jurisdictions in which we do business; nothing in these policies creates rights or liabilities beyond what the law requires.
Information for visitors from the European Union
Where the EU General Data Protection Regulation (GDPR) applies to a visit from the European Union, the controller is Bodega Maria Luisa S.A.S., Espejo 65, 1° Piso Dpto. F, (5500) Mendoza Ciudad, Argentina, contact@cicloandino.com. Our representative in the Union under Article 27 GDPR is Perdriel Wine Import GmbH, Germany, which also operates our EU online shop; its full company details are in the imprint at shop.cicloandino.com/impressum. Orders placed in the EU are handled by that company under its own terms.
We only process personal data that you give us yourself, for the following purposes and on the following legal bases:
- Answering enquiries and arranging visits, tastings, dinners and stays: performance of a contract or steps prior to it, Art. 6(1)(b) GDPR.
- Trade and press enquiries: performance of a contract or our legitimate interest in responding to a business approach, Art. 6(1)(b) and (f) GDPR.
- Sending our newsletter: your consent, Art. 6(1)(a) GDPR, which you may withdraw at any time with no effect on processing already carried out.
- Confirming that you are of legal drinking age: our legal obligation and legitimate interest, Art. 6(1)(c) and (f) GDPR. That confirmation is stored only in your own browser and is never transmitted to us.
- Operating and securing the website, including the log files created by our hosting provider: our legitimate interest in a functioning, secure site, Art. 6(1)(f) GDPR.
How long we keep your data
Enquiry and booking correspondence is kept for as long as needed to deal with your request and afterwards only where Argentine commercial and tax law requires it. Newsletter addresses are kept until you unsubscribe. Server log files are deleted or anonymised by our hosting provider after a short period. Where data is no longer needed for any of these purposes, we delete it.
Who receives your data
We do not sell personal data and we do not use it for advertising profiling. Besides ourselves, data may be handled by: our hosting and email provider; the booking engine used for room reservations, hotelpms.io, when you book a room; Google Workspace, where enquiries and newsletter sign-ups are received and stored; Perdriel Wine Import GmbH for EU orders and trade enquiries; and, where legally required, public authorities. Each processor acts on our instructions under a data processing agreement.
The website loads its typefaces from Google Fonts, which means your IP address is transmitted to Google when a page is opened. This site sets no analytics, tracking or advertising cookies; the only value stored on your device is your age confirmation, which stays in your browser.
Transfers to Argentina
Because we are established in Argentina, data you send us is processed there. The European Commission has recognised Argentina as providing an adequate level of data protection in Decision 2003/490/EC of 30 June 2003, so such a transfer needs no further safeguards. Any transfer to a country without an adequacy decision is made on the basis of the European Commission's standard contractual clauses.
Your rights
If the GDPR applies to your data, you have the following rights, free of charge, by writing to contact@cicloandino.com:
- Access to the data we hold about you, Art. 15 GDPR;
- Correction of inaccurate or incomplete data, Art. 16 GDPR;
- Erasure of your data, Art. 17 GDPR;
- Restriction of processing, Art. 18 GDPR;
- A copy of the data you provided, in a portable format, Art. 20 GDPR;
- Objection to processing based on our legitimate interests, Art. 21 GDPR;
- Withdrawal of consent at any time, Art. 7(3) GDPR, for example by using the unsubscribe link in any newsletter;
- A complaint to a supervisory authority: in Germany the authority of your federal state, and in Argentina the Agencia de Acceso a la Información Pública.
